Fare evasion Notices of Violation
If you receive a Notice of Violation for fare evasion, your Notice of Violation does not indicate the amount of the fine that you have to pay. The amount of the fine depends on whether you have received any other Notices of Violation for fare evasion in the past four years. View more information on fare evasion fine amounts.
TAB will mail you a Notice of Warning or a Notice of Fine, which you should receive within 15 days after the date you received the Notice of Violation.
If this is your first fare evasion violation in the past four years:
- There is nothing to pay, and no need to respond.
- You will receive a Notice of Warning in the mail.
- You may contest the violation by hearing, on or before the hearing date on your Notice of Violation.
If this is not your first fare evasion violation in the past four years:
- You will have to pay a fine.
- You will receive a Notice of Fine in the mail that will tell you how much you owe.
- You may contest the violation by hearing, on or before the hearing date on your Notice of Violation.
If you haven’t received a Notice of Warning or Notice of Fine within 15 days, it is important that you contact TAB to let us know. If the address on your Notice of Violation is not your current mailing address, you must update your address.
Fair Fares NYC fare evasion fine reduction or waiver
If you are a participant in Fair Fares NYC at the time you receive your Notice of Violation, you are eligible to have your fare evasion fine reduced by 50%.
If you are not a participant in Fair Fares NYC at the time you receive a Notice of Violation for fare evasion, you may be eligible to have your fine waived if you enroll in Fair Fares prior to your hearing date.
Responding to your Notice of Violation
You must respond to the Notice of Violation by the hearing date on the Notice of Violation. If you don't, you'll be responsible for paying the fine and penalties, as well as interest that accrues after the hearing date.
You must respond by either paying the fine or disputing the charge by the hearing date listed on your Notice of Violation.
Penalties for failure to pay
If you do not respond by the hearing date listed on your Notice of Violation, a $25 penalty will be applied. If you fail to respond again, a second $25 penalty will be applied 30 days after the hearing date.
Collection of unpaid fines and penalties
Unpaid fines and penalties are collected by TAB through letters, telephone calls, court actions, and other enforcement efforts including garnishment of wages and state tax refunds and enforcement by a New York City Marshal or Sheriff. Interest on unpaid amounts will accrue at the rate of 9% per year.
